Tatiana Kyselova has published a research article “Pretenziia Dispute Resolution in Ukraine: Formal and Informal Transformation”, 40(1) Review of Central and East European Law, 2015 http://booksandjournals.brillonline.com/content/journals/15730352/40/1. The article traces historical roots of the pretenziia dispute resolution institution in Soviet law and demonstrates that Ukrainian businesses continue to rely on it. It is proposed that pretenziia should be integrated into current debates on Alternative Dispute Resolution (ADR) in post-Soviet societies and can serve as an on-the-ground foundation to support the introduction of mediation and other ADR mechanisms there.
