Commercial mediation

It is offered as an alternative to adjudication for settlement of commercial disputes, family disputes, labor disputes, etc. This method is both efficient and cost effective.

  1. To find a solution, which is beneficial for all parties to a dispute (win-win strategy)
  2. To save time for preparation for hearing and hearing of a case at the court.  
  3. To save funds that otherwise would be spent to cover the cost of court procedures.  
  4. To preserve partner relations.
  5. To receive emotional satisfaction from the method and result of conflict settlement.  
  6. To multiply increase the probability that the decision adopted by the parties will be actually fulfilled.  
  7. To secure the confidentiality of conflict settlement.  


Mediation in organization and creation of conflict management system

Mediation is part of organization’s conflict management system. The presence of internal mediator makes it possible to achieve the following:

  1. To reduce costs (both in terms of time and finances) incurred in connection with discussion of conflict substance at all levels, including top management level.
  2. To improve emotional climate in the organization.  
  3. To overcome employees’ apprehension and unwillingness to bring a conflict to discussion (due to confidential nature of mediation).  
  4. To make the workers’ collective more stable due to reduced personnel turnover and resultant decreased outflow of internal, commercially sensitive and valuable information.  
  5. To save costs related to the search of new employees, their adaptation and training.  

Organization’s conflict management system includes the following:

  1. Diagnostic analysis of the status of conflict probability/conflict proneness in organization.

  3. Development of measures aimed at establishing the system of effective conflict management, including training, consulting, coaching, independent mediations, training of internal mediator, etc.

Special bonus for active participations of UMC projects
– project on implementation of conflict management system in cooperation with Saint Tomas University [Minnesota, USA] aimed at analyzing the status of conflict management in organization, developing the design of conflict management system, and working with organization leaders on practical implementation and subsequent maintenance of conflict management system. The project is implemented at the expense of UMC own funds and additional funding attracted from other sources.
