Introduction

This code is based on the European Code of Conduct for Mediators. The European Code of Conduct for Mediators is the result of fruitful collaboration an initiative group of practical mediators representing more than 30 European organizations. The Code was developed with the support of the European Commission and approved at a conference at Brussels 02.06.04

Mediator’s Ethical Code should serve as a fundamental ethical and professional guide to persons involved in mediation in any field. The standards set out in this Code should:

• serve as a guide for mediators' behavior;
• serve as a source of information for the parties to the dispute;
• increase public trust in mediation as an effective ways of dispute resolution.

The standards of this Code should be applied in all types of mediation. However, in certain cases their application may be affected by a law or a contract between the parties.

Organizations can make these commitments by imposing requirements on their mediators.

Mediators can also make these commitments by requesting
from their mediators to adhere to the Code. Organizations can publish information about what they are doing to ensure that their mediators comply with the Code, for example, through training, evaluation and monitoring of their activities.

According to the Code, mediation is any process where two or more parties agree to involvement of a third party -- hereinafter referred to as a mediator, to help the parties to resolve the dispute by agreement without court intervention.

Mediators can develop more detailed codes that are adapted
to a specific context, type of services offered, or to specific areas such as mediation in family relations, in the sphere of consumption, labor disputes, restorative justice.
